Terms and Conditions

The following terms and conditions of use apply to any systems that you may use within the Secure Services Gateway (SSG).

Definitions and Interpretation "we" and "us" means the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women.
"you" means the legal entity or entities using this site.
"system" means a system to which you have access pursuant to this agreement.
"this site" means equipment, programs and services provided to allow you access to systems through the Secure Services Gateway
"service provider" means a Queensland Government Department or other non-government body contributing and/or providing support for this site.
"data" means all information contained within the systems provided on the Secure Services Gateway. Data may be hosted overseas and is subject to the Information Privacy Act 2009 (Qld).
"normal business hours" means Monday to Friday between 9am and 5pm, excluding Public Holidays.

Terms of agreement

Your access to the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women site is conditional upon your acceptance and compliance with these Terms and Conditions. These Terms and Conditions include the terms and conditions in our Privacy, Disclaimer and Copyright statements.

TThis agreement shall commence when you have been provided with access (username and password) to the Shared Services Gateway. This agreement constitutes the whole agreement between you and us, and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.

Your use of, and/or access to, the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women information constitutes your agreement to the Terms and Conditions. We have the right to change or discontinue these Terms and Conditions or any feature at any time, including content, hours of availability, equipment required for access, and these Terms and Conditions.

You further agree that the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women are not liable for any direct, indirect, incidental or consequential loss or damage that may occur through the use of this site, and you indemnify the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women against all claims for loss or damage and any other liability whatsoever arising out of your use of this site.


Changes to the Terms and Conditions

The Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women may change these terms and conditions at any time. If this occurs, the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women will notify you on this site.


Minimum System Requirements

This site uses Internet technology. It is your responsibility to meet the site's system requirements. These requirements may vary from time to time.

Once you access the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women systems within the Secure Services Gateway, your transaction across the Internet is protected by high-strength 128 bit SSL encryption, provided you are using versions 4.0 or later of either Microsoft Internet Explorer, Chrome or Firefox. If you are using an older web browser, the strength of encryption will be lower, usually 40 bit SSL. It is strongly recommended that all users of this site upgrade their browser to versions that support 128 bit SSL encryption.


Transmission speed

We have no control over the speed of transmission of data where the Internet is used for access.


Interruption to service

We do not promise that your access to this site will be uninterrupted (except to the extent, if any, which such a promise might be implied by law and be incapable of exclusion by us). We will use our best efforts to provide access during normal business hours. However, there may be an interruption to services to facilitate urgent reasonable maintenance by us.

We will not be liable to you or third parties for interruptions to the service beyond our control including but not limited to:

- Problems with your telecommunications services;
- Problems with your Internet Service Provider; or
- Problems with your hardware or software.
(Except to the extent, if any, where we may not be able to lawfully exclude such liability).

We will not be liable to you or third parties if interruptions to this service cause delays in the processing of payments or the delivery of services.


Governing law

This agreement shall be governed by and interpreted in accordance with the laws of The State of Queensland, Australia.


Waiver

None of these Terms and Conditions will be taken to be waived except by written notice signed by you and us.


Intellectual property and copyright

You acknowledge that you do not acquire any property rights in system information provided to you by the systems that you have access to.


Username and password security

Your username and password are confidential and only for use by yourself. You are totally responsible for the use of your username and password and for maintaining their security.

You shall be responsible for any use whatsoever of your username and password whether authorised or not.

This system allows you three attempts to enter your username and password. After the third failed attempt, you will be temporarily denied access to the Secure Services Gateway.


Acceptable Use

You shall only use the data from the systems for use in the ordinary course of your business.

You agree to abide by our Privacy requirements in the collection, storage, usage and disclosure of personal information.


Cancellation or suspension of access

The Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women can cancel or suspend your access to this site or any system within this site at any time.

The agreement set out in these terms and conditions may be terminated by the Department of Communities, Disability Services and Seniors or the Department of Child Safety, Youth Justice and Women at any time without notice. All disclaimers by the Department of Communities, Disability Services and Seniors and the Department of Child Safety, Youth Justice and Women will continue after termination.
